§ 2.41.080. Vacation leave.

  • A.

    Subject to and in accordance with the provisions of this section, paid vacation shall be earned by exempt personnel after a continuous act of service pursuant to the following schedule:

    1.

    After the exempt employee has completed one full year of service, such employee shall be entitled to one week of vacation.

    2.

    After the exempt employee has completed two full years of service, such employee shall be entitled to two weeks of vacation.

    3.

    After the exempt employee has completed seven full years of service, such employee shall be entitled to three weeks of vacation.

    4.

    After the exempt employee has completed fifteen full years of service, such employee shall be entitled to four weeks of vacation.

    5.

    After the exempt employee has completed twenty full years of service, such employee shall be entitled to five weeks of vacation.

    B.

    A week of vacation for all exempt employees shall consist of five full working days.

    C.

    The purpose of a vacation is to enable the exempt employee to enjoy periodic rest from his regular job so that he may return to his work refreshed. The vacation year will be the individual exempt employee's anniversary date.

    1.

    Up to ten days of earned vacation not used by the exempt employee's anniversary date may be used up to six months subsequent to such date. Days not used by that time are then forfeited by the exempt employee.

    2.

    No exempt employee shall be entitled to vacation pay in lieu of vacation.

    An exempt employee who terminates employment for any reason shall receive any vacation earned and not previously taken. For purposes of this section, vacation earned shall have the meaning as used in Subsection A of this section. Earned vacation shall be prorated on a monthly basis for the year (anniversary date year) in which termination occurs.

    D.

    So far as possible, each vacation will be granted at the time selected by the exempt employee so long as it does not conflict with the operation of the city; provided, that the final right to allot vacation periods and the right to change such vacation period is reserved exclusively to the city.

    E.

    In the event that a holiday falls within an exempt employee's vacation period, such day will not be counted as a day of vacation.
